ON 19 Apr this year, Mr Lee Voot Seong, 51, was stopped at Tuas checkpoint, where his urine tested positive for prohibited drugs.
He was arrested and charged with the consumption of methamphetamine, an offence under the Misuse of Drugs Act.
His lawyer, Mr Tan Hee Joek of Drew & Napier, argued that Mr Lee did not have any intention of consuming a prohibited drug.
Mr Lee said he had bought the 'Indian Viagra' tablets for RM$5 ($2) each to treat his erectile dysfunction, according to court papers.
Mr Lee had previously been prescribed Viagra pills for $50 each here.
Before his arrest, Mr Lee had purchased 'Viagra' pills from street peddlers in Johor Baru on two occasions, the court heard.
On the first two occasions, he had purchased a packet containing four blue pills.
When he found these pills to be ineffective, he bought a white box containing four red pills which the street peddler told him was 'Indian Viagra'.
In April this year, Mr Lee consumed one red pill before leaving Singapore to make some deliveries in Johor.
ARRESTED
Mr Lee was arrested on his return to Singapore the same day.
He claimed he had always believed the pills to be 'Indian Viagra', and did not suspect them to contain Ice.
District Judge Shaiffudin Saruwan was not satisfied that Mr Lee was aware the pill contained a banned substance.
So Mr Lee was acquitted. If convicted, he could have been jailed for up to 10 years or fined $20,000, or both.
